Holly L. Carto joined Latimer LeVay Fyock LLC in November of 2013. Holly’s practice focuses on representation of banks and individuals as it relates to loan collection and resolution of troubled loans. She has been involved in the completion of thousands of foreclosures, both commercial and residential. Her practice also concentrates on loan workouts, including loan modifications, forbearance agreements, consent foreclosures and deeds in lieu of foreclosure. She has defended banks in commercial litigation, mechanics lien litigation, building code actions as well as lien priority disputes and title claim issues. She also represents creditors in Chapter 7 and Chapter 13 Bankruptcy proceedings.

Summary of Professional Experience and Representative Clients:

  • Draft pleadings for motion practice in both State and Federal Court
  • Issue and respond to discovery in foreclosure and collection actions
  • Successfully negotiated and completed over 50 settlement agreements in favor of and on behalf of clients
  • Negotiate and draft Forbearance Agreements, Deed In Lieu Agreements and other Settlement Agreements on behalf of clients
  • Review title reports, file title claims and monitor claims through resolution
  • Expeditiously update clients with local and federal laws involving banking and/or real estate laws
  • Prepare transactional documents including loan documents and note sale agreements; review and negotiate real estate sales contracts and attend closings on behalf clients
